METHODOLOGY - Normalization
I have spent over twenty years fighting to protect America from socialist/communist/statist threats, from Vietnam to Desert Storm. For over thirty years I walked "the thin blue line". I can state, unequivocally, that the actions of the current committee prove, beyond a reasonable doubt, that they have, in effect, become the equivalent of the court of star chamber and The "monarch" they serve today is the Marxist, Socialist Commiecrat Party and their Axis Of Evil!
This committee is not the first such committee. It began about thirty years ago with the confirmation of Robert Bork. Bork, like Kavanaugh was an "originalist" who believed that:
"interpretation of a written constitution or law should be based on what reasonable persons living at the time of its adoption would have declared the ordinary meaning of the text to be"
As you can remember, from the discussion on Constitutional Interpretation, originalism is anathema to the AOE who invented the euphemism "living Constitution" to disguise their belief that the Justices should be able to "rewrite" the constitution to fit their personal views or the latest "popular" fashion.
There is one glaring problem with such a "theory" - The Constitution DENIES the Supreme Court the power to CREATE law! That power is ONLY given to the Legislative Branch. The minute the Court applies the concept of a "living Constitution" they are forsworn! (emphasis added):
“The Senators and Representatives before mentioned, and the Members of the several State Legislatures, and all executive and judicial Officers, both of the United States and of the several States, shall be bound by Oath or Affirmation, to support this Constitution;...";
“I, _________, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same;..."
The KGB recognized when they began ideological subversion in the United States that the greatest strength of our nation was our Constitution. Even the rabid socialist George Bernard Shaw understood this and stated that we would have to get rid of our Constitution if socialism were to have a chance in America.
By now, it should be obvious that the Axis Of Evil is totally, completely a creation of, and a tool for, theDemocrat...Commiecrat Party! Being fellow socialists they, like their KGB partners, understood the barrier the Constitution was to their plans to subjugate our Republic under Communism. They also recognized that the greatest threat TO our Constitution was the Supreme Court. Remember! Jefferson warned us about this danger (emphasis added):
"BUT THE OPINION which gives to the judges the right to decide what laws are constitutional, and what not, not only for themselves in their own sphere of action, but for the legislature and executive also, in their spheres, would make the judiciary a despotic branch."
Thomas Jefferson wasn't the only warning we had, the latest warning - if anybody was listening - was from Barry the First! When Barry was first running for election he was interviewed, on the radio, concerning his views on the Supreme Court and the Constitution (emphasis [comments] added):
"As radical as I think people tried to characterize the Warren Court, it wasn't that radical. It didn't break free from the essential constraints that were placed by the Founding Fathers in the Constitution"
[Speaking about the Constitution] "...a charter of negative liberties that says what the states can't do to you, says what the Federal Government can't do to you [That's what it's supposed to do!] but it doesn't say what the federal government, or the state government, must do, on your behalf."
Do you sense the phrase "the State is mother, the State is father..." behind his words back then? If you didn't, you were not alone but it didn't take very long for it to become obvious what he was saying.
For over thirty years the Commiecrat Party has hijacked the judicial confirmation process - at all levels but, particularly, the Supreme Court. Take a look back over that period. Do you notice a pattern? The Supreme Court today has nine justices. Any time a Judge who was, or might be, an originalist theCourt Committee of Star Chamber appeared. As long as there was a majority (at least 5) Socialist Justices an originalist might make it onto the court (if Republicans had enough votes).
On the other hand, does anybody remember the confirmations of Ginsburg or Breyer? Both were "liberal" judges regularly siding against the 4 originalists (Kennedy was considered a "swing" vote). Ginsburg was confirmed with a 93 to 6 vote. Breyer was also confirmed with a vote in the 90s. In both cases the votes were bipartisan! Let the nomination to the Court from a Republican president pass? Hell no. There is nothing that the Commiecrats and the AOE will not stoop to. Destroy a completely innocent man? Of course they would, THEY ARE! To Commiecrats any "conservative" is GUILTY UNTIL PROVEN INNOCENT AND HAS NO LEGAL RIGHTS!
